On the West side of Thunder Swamp.  Beginning at a stake his own corner in his field and runs with his line N 25 E 192 P. to a Red Oak in or near Kornegay's line, then with or near said line S 35 E 100 P. to a Post Oak, his corner in Aaron Martin's line, then with his line S 50 W 60 P. to a Blackjack the corner, then S 1144 P. to a Pine near an open Meadow, then W 40 P. to a stake, then to the Beginning, Containing 140 acres.

I, Charles Wolf Snr. of Wayne County and State of North Carolina being of sound and perfect mind and memory do this 26th. day of October in the year of our Lord Christ one thousand eight hundred and thirty one make and publish this my last Will and Testament in manner and form following, (and hereby revoking all my former Wills) that is to say.
First - I give and bequeath (after my just debts are paid) one fourth part of the land where I now reside unto my daughter Charity Manly and likewise one fourth part of all my other Estate of every kind unto her the sd. Charity Manly, her heirs and assigns forever.
Secondly - I give and bequeath one fourth part of the land Wnere I now reside unto my Grand-Daughter Polly Manly and to be laid off adjoining the land before given to the sd. Polly's Mother and including the dwelling house and likewise one fourth part of all my other Estate unto her the sd. Polly Manly my Grand Daughter, her heirs and assigns forever.
Thirdly - I give and bequeath unto my daughter Mary King, of Sampson County, one half the land where I reside and likewise one half of all my other Estate unto her the sd. Mary King her heirs and assigns forever.
And I the sd. Charles Wolf the Testator do hereby constitute and appoint John Eliot Snr, and John Eliot Jnr, Executors to this my last Will and Testament, in testimony whereof I the sd. Charles Wolf the Testator have here to set my hand and affixed my seal the day and year above mentioned. In the presence of us who were Present at the time of Signing and Sealing.

The Last Will and Testament of Charles Wolf Snr., dec'd. was offered for probate in open Court and proved by the Oath of David Giddens and William Clark before witnesses thereto, let the same be recorded. At the same time John Eliot Jr. one of the Executors therein named qualified as Executor,

I, Edith Wolf of Wayne County and State of North Carolina being of sound and perfect mind and memory do this 17th. day of October in the year of our Lord Christ one thousand eight hundred and thirty one make and publish this my Last Will and Testament in manner and form following, that is to say.
First - I give and bequeath to mv Sister Chelly Manly and my niece Polly Manlv the whole of my land as left me by my Father Charles Wolf's Will, reference thereunto being had, to be equally divided between them the sd. Chelly and Polly Manly, to them their Heirs and assigns forever.
Secondly, I give twenty dollars unto my two nieces. Nancy and Sally Manly to be equally divided between them.
Thirdly - I give the residue of mv Estate, goods and chattels as left to me by the Will of my Father Charles Wolf and any other chattels of my own acquiring unto my Sister Chelly Manly and my niece Pally Manly to be equally divided between them, to them, their Heirs, and assigns forever.
And I the sd. Edith Wolf do hereby constitute and appoint John Eliot Snr. and John Eliot Jnr. Executors to this my Last Will and Testament.
Signed, Sealed, Published and declared by the sd. Edith Wolf the Testatrix as her last Will and Testament in the Presence of us who were Present at the time of Singing and Sealing.

1. A Note on David Johnson and John Cotton endorsed as good by James Rhodes, payable to Edith Wolf the Testatrix on the 25th. of Dec. 1831 with interest from the 1st. day of May 1830, for $150.00.

To the Worshipful the Justices of the Court of Pleas and Quarters of Wayne County.
The petition of Richard Wolf, Theophilus Guy and Charlotte wife, and Henry Nunnery and Nancy his wife, respectfully sheweth unto your worships, that on the ____ day of ____ 1831, Charles Wolf late of
said County died, that your Petitioners Richard, Charlotte and Nancy are the children of said Charles by his first marriage, that the said Charles had also a son by said marriage by the name of John Charles Wolf who removed to Georgia and died leaving (as your Petitioners have been informed and believe) four children whose names are unknown to your Petitioners.
Your Petitioners further shew that after the death of his first wife, the said Charles Wolf married again and had several chiidren, two of whom, Viz., Charity, wife of James Manly of Wayne, and Mary, wife of Bryant King of Sampson, alone survived the said Charles, the others dying in his lifetime without issue.
Your Petitioners further shew unto your worships that the said Charles died possessed of a considerable real and personal estate amounting, as they have been informed and believe, to the sum of Four or Five Thousand Dollars, and that at November Term 1831 of this Worshipful Court a paper writing purporting to be the last Will of Charles was exhibited for Probate and admitted by said Court to be proven in common form, and John Eliot, Jnr. qualified as Executor thereto.
Your Petitioners further shew unto your Worships that the said writing bears date a very short time before the death of said Charles, that at the date thereof he was more than One Hundred years of age, that he was in a state of complete dotage, being very imbicile in mind and infirm in body, that he was blind, and did not know his own children.
In this condition your, Petitioners charge that the said Charles was utterly incapable of making a Will, and that the paper writing aforesaid was unduly and fraudulently obtained, or procured to be executed.
Your Petitioners shew that by said writing the whole of said Charles' property is given to his children by his last marriage, and your Petitioners and the minor Grand Children of said Charles in Georgia are fraudulently and unjustly deprived of their patrimony.
Your Petitioners further charge that they had no notice nor information that the said paper writing would be offered for Probate as aforesaid, and that the said Grand Children of said Charles Wolf, or some of them are and were at the time of said Probate, minor and non resident.

In consideration of the premises and to the end that the rights of your Petitioners may not be barred without an opportunity of being heard in their defense, mav it please your Worhips to order said probate to be set aside, that those in in the probate of said instrument as a Will, may be at liberty to offer the same for re-probate if they think proper so to do and that your Petitioners may have an opportunity of filing a caveat thereto and contesting the validity thereof. That your Petitioners have such other and further relief as the nature of their case may require.
And that the said John Eliot Junr., the said James Manly and Charity his wife, the said Bryant King and Mary his wife, and the said minor children of John C. Wolf, and all interested may be duly notified of the filing of this Petition and be made parties thereto in due form of law, that they may shew cause if any they have why the Prayer of your Petitioners should mt be granted.

To Bryan(t) King and Mary his wife, you are hereby notified that a paper writing purporting to be the last Will and Testament of Charles Wolf dec'd. has been exhibited for Probate at last term of this Court which a caviate has been filed by Richard Wolf and others and an issue made up to try the same according to law.

Richard Wolf married Mary (Polly) Carraway, daughter of Adam and Susannah (Oates) Carraway, of Wayne County, N.C. Richard Wolf owned land in Duplin and Wayne County, N.C. His Will dated 2-14-1844 and Probated Nov. Term 1848, in Sampson County, left all of his land to his only son, Sebron J. Wolf (spelled Sebourn in Will). Five daughters named: Oldest - Elizabeth Smith, dec'd., Lidey Bell, Peggy Bell, Lucy Wolf and Sally Wolf.
